Is THC Legal in Minnesota?
Minnesota legalized hemp-derived THC edibles in 2022, but the rules aren't always straightforward. Whether you're a first-time buyer or a regular customer, here's everything you need to know about THC legality in Minnesota heading into 2026 — including what's changing.
Yes, THC Is Legal in Minnesota
Minnesota legalized the sale of hemp-derived THC edibles and beverages on July 1, 2022. The law allows adults 21 and older to purchase and consume THC products that meet specific potency limits. You do not need a medical card, a prescription, or any special license — just a valid government-issued ID proving you're 21 or older.
This applies specifically to hemp-derived THC products — meaning the THC is extracted from hemp plants containing less than 0.3% Delta-9 THC by dry weight, in compliance with the federal 2018 Farm Bill. The products you'll find at stores like Love Is An Ingredient are fully legal under both Minnesota state law and federal law.
What Are the THC Limits in Minnesota?
Minnesota law sets two limits for hemp-derived THC edibles and beverages:
Key Limits
5mg of THC per serving — each individual piece, gummy, chocolate, or drink serving can contain up to 5mg of THC.
50mg of THC per package — the total amount of THC in the entire package cannot exceed 50mg.
For example, a typical package of THC gummies might contain 10 gummies at 5mg each, totaling 50mg per package. Some products also contain CBD alongside THC — a popular option is a 1:1 ratio (5mg THC + 5mg CBD per serving) for a more balanced experience.
These limits apply to Delta-9 THC, which is the primary psychoactive compound in cannabis. Delta-8 THC products are also available in Minnesota, though they tend to produce milder effects. Both are legal when derived from hemp.
What Types of THC Products Can You Buy?
Minnesota's law covers edibles and beverages specifically. This includes a wide range of product types:
Gummies are the most popular category, but THC-infused chocolates, seltzers and beverages, and tinctures have all grown rapidly since legalization. At Love Is An Ingredient, we also carry CBD-only products and functional mushroom supplements for customers looking for non-psychoactive wellness options.

Brooklyn Park — 8505 Jefferson Ln N, MN 55445

Are THC Products Safe?
When purchased from a reputable retailer, yes. The key is third-party lab testing. Every product sold at Love Is An Ingredient is lab tested for potency (to verify the THC and CBD content matches the label), purity (to screen for contaminants like heavy metals, pesticides, and residual solvents), and compliance with Minnesota's legal limits.
We carry trusted brands like Retro Bakery (our sister brand, manufactured in-house in Minnesota), Edwin's Edibles, and Botany Farms — all of which meet our strict quality standards.
Dosing Tip for Beginners
If you're new to THC, start with 2.5mg (half a standard serving) and wait at least 90 minutes before taking more. Edibles take longer to kick in than other methods — usually 30 to 90 minutes. Start low, go slow.
Will THC Show Up on a Drug Test?
Yes. Hemp-derived THC is real THC, and it will trigger a positive result on standard drug tests. This is true for both Delta-9 and Delta-8 products. If you are subject to drug testing for employment or any other reason, keep this in mind before consuming any THC product.
CBD-only products and functional mushroom supplements do not contain THC and will not cause a positive drug test result.
What's Changing in 2026?
Minnesota's cannabis landscape is evolving. The Office of Cannabis Management (OCM) has set a March 31, 2026 deadline for cannabis businesses to obtain proper licensure under the state's new regulatory framework. This is part of Minnesota's broader transition toward a fully regulated cannabis market.
For consumers, the products you know and love aren't going away — but the regulatory structure around them is becoming more formalized. At Love Is An Ingredient, we're fully prepared for these changes and committed to compliance at every step.
There's also ongoing discussion at the federal level about hemp-derived THC regulations, with potential changes being debated in Congress. We'll continue to update this post as new developments emerge.
